These Terms of Use govern access to and use of MedConcil.
MedConcil is operated by GAITO LLC, a Nevada limited liability company.
By accessing or using MedConcil, you agree to these Terms.
Eligibility
You must be at least 18 years old to create a MedConcil account.
Medical Disclaimer
MedConcil provides AI-assisted health information, document analysis, medical information organization and clinical decision-support tools.
MedConcil does not replace a physician or other qualified healthcare professional.
AI-generated information may contain errors, omissions, incomplete information or inappropriate conclusions.
Do not start, stop or change medication, treatment, testing or other medical care solely because of information generated by MedConcil.
A qualified healthcare professional should review decisions affecting diagnosis, medication, treatment or medical procedures.
No Doctor-Patient Relationship
Use of MedConcil does not create a doctor-patient relationship between you and GAITO LLC.
A separate relationship may exist where an independent licensed healthcare professional provides services under separate terms.
Emergency Situations
MedConcil is not an emergency service.
If you believe you are experiencing a medical emergency, contact emergency services or seek immediate medical attention.
Artificial Intelligence
MedConcil uses artificial intelligence and automated systems to analyze information and generate responses.
AI output is informational and decision-support content.
MedConcil does not guarantee that AI output is complete, accurate, current or clinically appropriate for every person or circumstance.
Users remain responsible for reviewing information before relying on it.
Healthcare Professionals
Healthcare professionals using MedConcil remain responsible for their independent professional judgment, clinical decisions, documentation, prescriptions, diagnoses, treatment decisions and compliance obligations.
Pharmacogenomics and Genetic Information
Pharmacogenomic information describes associations between genetic variants and medication response.
A PGx result alone does not determine whether a medication is appropriate, effective or safe for an individual.
Medication decisions depend on many factors, including diagnosis, dose, other medications, allergies, kidney and liver function, age, medical history, laboratory results and professional clinical judgment.
Users should discuss PGx findings with an appropriate healthcare professional before changing medication.
Independent Laboratories and Providers
Some MedConcil services may involve independent laboratories, healthcare professionals, pharmacies or other third parties.
These parties operate under their own licenses, policies, professional responsibilities and terms.
MedConcil does not directly collect, store or process biological samples.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for activity associated with your account.
You must provide accurate information and promptly notify us of suspected unauthorized account access.
User Content
You retain ownership of information and documents you submit to MedConcil.
You grant GAITO LLC the rights required to host, process, analyze, reproduce and transmit this information solely as necessary to operate, secure and provide the Service.
You represent that you have the legal right or appropriate authorization to submit information concerning another person.
Adults and another person's information
Account holders must be at least 18. Only provide another person's medical information when you have the required permission or legal authority, including parental or guardianship authority where applicable. Being a relative does not by itself establish authority to upload, analyze or share their records.
Dedicated self, child, parent and other represented-person profiles are planned. The current patient form does not establish a verified guardianship or authority-checking service. Do not interpret the ability to enter a person's details as confirmation of your legal authority.
Processing choices and consent
Saving information, requesting an AI analysis and authorizing disclosure to another person are different purposes. Not all current workflows provide separate, versioned consent controls or an in-app withdrawal option. This policy does not claim that those controls already exist or replace any consent required by law. Contact legal@medconcil.com about permission, withdrawal or stopping further processing.
Acceptable Use
You may not use MedConcil to:
- violate applicable law;
- gain unauthorized access to systems or accounts;
- interfere with the operation or security of MedConcil;
- upload malicious code;
- impersonate another person;
- misrepresent your authority to provide information;
- attempt to circumvent security controls;
- use the Service for unlawful medical practice;
- use MedConcil in a manner likely to harm another person.
Intellectual Property
The MedConcil software, design, interfaces, branding, documentation and proprietary technology belong to GAITO LLC or its licensors.
Except for rights expressly granted under these Terms, no rights are transferred to you.
Purchases, subscriptions, fulfillment and refunds
One-time digital purchases cover the report or service described at purchase. Digital services are delivered through the MedConcil application; the scope, limits and expected availability must be disclosed before payment.
Subscriptions involve recurring charges and automatic renewal until canceled. The price, currency, billing period, included services and renewal conditions must be disclosed before purchase.
You may request cancellation by emailing hello@medconcil.com with your account email and subscription reference. Cancellation prevents future renewal charges; access continues through the current paid period unless applicable law or a disclosed offer provides otherwise.
A one-time report qualifies for a full refund before processing starts. Processing means an actual report-generation job has been accepted by the application, not payment alone unless generation starts immediately. If no report has started processing in a paid subscription period, you may request a refund of that period’s subscription charge.
After processing starts, change-of-mind refunds are generally unavailable. Duplicate charges, unfulfilled orders, material billing errors, service failures and legally required refunds remain subject to review. Full details and request instructions are in our Refund & Cancellation Policy.
Third-Party Services
MedConcil may connect to or rely on third-party services.
GAITO LLC is not responsible for third-party services outside MedConcil’s control.
Service Availability
We work to maintain reliable access to MedConcil but do not guarantee uninterrupted or error-free availability.
We may modify, suspend or discontinue features where reasonably necessary.
Disclaimer of Warranties
To the maximum extent permitted by law, MedConcil is provided on an “as is” and “as available” basis.
GAITO LLC disclaims warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, GAITO LLC and its officers, employees, contractors and affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from use of MedConcil.
To the maximum extent permitted by law, the total liability of GAITO LLC arising from the Service will not exceed the greater of the amount you paid to GAITO LLC for the Service during the twelve months before the event giving rise to the claim or one hundred United States dollars.
Some jurisdictions do not permit certain limitations of liability, so portions of this provision may not apply to you.
Indemnification
To the extent permitted by law, you agree to indemnify and hold GAITO LLC harmless from claims arising from your unlawful use of the Service, violation of these Terms, or violation of rights belonging to another person.
Termination
You may stop using MedConcil at any time.
GAITO LLC may suspend or terminate access where reasonably necessary because of violations of these Terms, security concerns, fraud, abuse or legal requirements.
Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, disputes concerning these Terms or MedConcil will be subject to the state or federal courts located in Clark County, Nevada.
Changes to These Terms
We may update these Terms as MedConcil changes.
Material changes will be communicated where required by law.
